Petition Filed in High Court to Stop NTSA Mandatory Vehicle Inspection

A petition has been filed before the High Court challenging the implementation of the National Transport and Safety Authority (NTSA)’s mandatory vehicle inspection regulations.

Constitutional lawyer Charles Mugane moved to court on Monday, June 29, seeking to halt the enforcement of the new rules, arguing that they were introduced without adequate public participation as required by the Constitution.

In the petition, Mugane also challenges the legality of the Ksh2,000 inspection fee and the Ksh20,000 penalty imposed on motorists, terming them unconstitutional and unfair to vehicle owners.

According to the lawyer, the regulations violate constitutional principles on public participation and fair administrative action, making the directives unlawful.

He is now asking the High Court to suspend the implementation of the new vehicle inspection rules pending the hearing and determination of the case.

The petition comes just days before the nationwide inspection exercise, which NTSA is set to roll out on Wednesday, July 1.
