High Court had ruled that the 50 CASs positions are unconstitutional
The High Court on Monday dealt President William Ruto a blow when it ruled that the creation of the CAS positions was unconstitutional.
The verdict attracted varied reactions from a cross-section of Kenyans among them constitutional experts.
Ruto on March 16, nominated 50 CASs for the position against 23 vacancies announced by the Public Service Commission.
The 50 were nominated from a list of 240 shortlisted candidates.
The High Court later issued orders barring the CASs from assuming office pending the hearing and determination of a petition challenging the process of their appointment.
“Pursuant to Article 143 of the Constitution and based on the law as set out above, we find that the first respondent was improperly enjoined to the consolidated petition,” the judge said.
