Court Halts Githunguri Housing Project Amid Cultural Dispute

The High Court in Kiambu has ordered an immediate suspension of a controversial affordable housing project in Githunguri, intensifying an ongoing dispute between the government and Agikuyu elders over land ownership and cultural heritage.

In a ruling delivered by Justice Bahati Mwamuye, the court directed the contractor to stop all construction activities on the disputed 58-acre land and vacate the site immediately. The judge also ordered the demolition of a perimeter wall already built and instructed that the status quo be maintained until the case is fully heard and determined.

Further, the contractor has been ordered to remove all machinery, equipment, and fencing from the land, restoring it to its original state before construction began.

The ruling follows rising tensions between authorities and members of the Agikuyu community, who oppose the project on cultural and historical grounds. The dispute escalated last week when elders were blocked by police from accessing the land to perform traditional rituals.

Despite the restriction, the elders carried out symbolic rites by the roadside, including breaking a calabash as a curse against those they accuse of undermining Kikuyu heritage.

The contested land, known as Githunguri Kia Wairera, is considered a sacred ancestral site. Elders say it holds deep historical significance, with claims that at least 54 Mau Mau fighters were executed there during the colonial era, making it a powerful symbol of resistance and sacrifice.
