High court issues orders suspending PSC from Petitions against DPP Noordin Haji

High court judge Justice James Makau on Thursday barred PSC from acting on the two petitions filed by the late Tob Cohen sister and a businessman.

The court has also barred the Judicial Service Commission (JSC) from sitting or hearing the petition pending hearing and determination of a case the DPP has filed to block actions against himself and his office at the high Court. The petitions before the court seek to remove Director of Public Prosecution from office.

Haji through his lawyer told the court that the people behind the cases against him, Gabriel Hannah van Straten and Ibrahim Ndungu Ndirangu were out to force and intimidate him into preferring murder charges against Court of Appeal judge Sankale Ole Kantai. The DPP says the two petitions are malicious adding that the Public Service Commission has no jurisdiction to hear the matter. 

Judge Justice Makau also granted respondents in the case namely Gabriel, Ndung’u, PSC and interested parties Sarah Wairimu, Peter Karanja, Court of Appeal judge Sankale Ole Kantai ten days to file their pleadings in the matter filed by the Office of the DPP and DPP boss Haji.
