Supreme Court of Kenya has on 9th November, 2021 dismiss application seeking to bar 3 judges from hearing BBI appeal case

In his application, Aluochier wanted Justices Njoki Ndungu, Smokin Wanjala and Mohammed Ibrahim to recuse themselves saying he had filed a petition before JSC for their removal. Aluochier said the BBI appeal should be resolved by an impartial bench of judges and the three judges appear not to be impartial in the matter before the court.
