Three-judge bench comprising of James Wakiaga, George Dulu and William Musyoka, sitting in Nairobi, made the decision on Thursday, October 21, 2021 that President Uhuru Kenyatta appoint the remaining six out of 40 judges he declined to approve in June within the next 14 days.

The six nominees are Joel Ngugi, George Odunga, Weldon Korir, Aggrey Muchelule, Registrar of the High Court Judy Omange and Chief Magistrate Evans Kiago.

If the President fail to honor the order issued by the court, the six judges would be presumed as formally appointed, and the Chief Justice would organize their swearing-in.

The same court has also declined to suspend its own decision pending an intended appeal and directs the respondents in the case to file a formal application. The respondents are the President, Chief Justice and the Attorney General.
